Il regolamento conferma che ogni trattamento deve trovare fondamento in un'idonea base giuridica, come il consenso, l'adempimento di obblighi contrattuali, gli interessi vitali della persona interessata o di terzi, gli obblighi di legge, l'interesse pubblico o l'esercizio di pubblici poteri e l'interesse legittimo prevalente del titolare o di terzi. Il consenso deve essere esplicito per i dati sensibili e per le decisioni basate su trattamenti automatizzati, e deve essere libero, specifico, informato e inequivocabile. Il consenso dei minori è valido a partire dai 16 anni e deve essere raccolto dai genitori o da chi ne fa le veci prima di tale età. È opportuno verificare che il consenso raccolto precedentemente al 25 maggio 2018 sia ancora valido secondo le nuove prescrizioni del regolamento.
