Summary

The GDPR does not define "transfer of personal data to a third country or international organisation", so the EDPB provides guidelines to clarify when Chapter V requirements apply, identifying three cumulative criteria:
1) a controller/processor is subject to the GDPR,
2) personal data is disclosed to another controller/processor,
3) the recipient is in a third country or international organisation.
If these criteria are met, Chapter V applies, and transfers can only occur under certain conditions, such as an adequacy decision or appropriate safeguards.
If not met, Chapter V does not apply, but the controller must still comply with other GDPR provisions and consider risks associated with processing outside the EU.
