Summary

Pearson Benelux B.V. is uitgever van psychologische tests en heeft een databankenrecht op basis van de Databankenwet. De tests bestaan uit een vraaglijst, testmateriaal, scoreformulier en handleiding met normtabellen. [Verweerster 1] heeft een softwareprogramma ontwikkeld dat tests van Pearson en andere uitgevers kan "scoreren" en heeft daarvoor normgegevens en scoringsregels uit Pearsons handleidingen overgenomen. Pearson heeft [verweerster 1] gesommeerd om het gebruik van haar tests te staken wegens inbreuk op haar databankenrecht. Het hof heeft geoordeeld dat [verweerster 1] geen inbreuk maakt op Pearsons databankenrecht omdat de investeringen die Pearson heeft gedaan, zien op het ontwikkelen en controleren van het toetsingsmateriaal en niet op de wijze van ontsluiting van dit materiaal. Het middel van Pearson is gericht tegen dit oordeel.
