Summary

Human rights are basic and necessary rights granted to all citizens, regardless of gender, caste, religion, or nationality. The concept of human rights originated from natural law and was established through international charters and conventions after World War II. Currently, 55 countries practice capital punishment, while 140 countries have abolished it. India is among the top 10 countries where capital punishment is still prevalent. The Indian Constitution guarantees fundamental rights, including the right to life and personal liberty, but the death penalty raises questions about the violation of Articles 14, 19, and 21. Landmark judgments, such as Bachan Singh v/s Union Of India and Rajendra Prasad v/s State of Uttar Pradesh, have addressed the issue of capital punishment, with the Supreme Court maintaining its legality but limiting its application to extraordinary cases.
