The exclusive right of "making available" covers offering a work to the public for individualized streaming or downloading, and actual transmission of a work to the public, regardless of technical means used. As applied to hyperlinks, the making available right covers links enabling public access to specific protected material, but not links merely referring to a source from which a work may be accessed. Infringement occurs when linking to targeted content without the rightholder's consent, or when technical protection measures are circumvented, or when the availability clashes with the rightholder's will. Courts should not introduce a general presumption of the rightholder's consent to further communication to the public of what was initially posted on the Internet with consent.
