Summary

The Appellate Division, First Department, unanimously affirmed a judgment awarding plaintiffs $2,500,000 for past pain and suffering, $4,000,000 over ten years for future pain and suffering, and $283,202.90 for past hospital, rehabilitation and medical expenses. The trial court providently exercised its discretion in charging the jury on the common carrier's duty when a passenger is disabled, considering plaintiffs infancy and the driver's knowledge of it. The jury's finding that defendants were solely at fault was supported by sufficient evidence and not against the weight of the evidence. Plaintiff suffered a serious injury to his right leg, including a fractured fibula and degloving injury, requiring extensive hospitalization and rehabilitation, resulting in scarring, worsening arthritic changes, permanent loss of range of motion and sensation, and a need for a future ankle fusion. Defendants offered no expert testimony on damages, and the damages award was not found to be excessive.
