Summary

Nina Ozuyener and Korkut Ozuyener executed a post-nuptial agreement in 2010 as part of an estate planning package, which determined the distribution of marital assets in the event of death or divorce. The agreement allocated significantly more assets to Nina. When Nina filed for dissolution of marriage in 2013, she requested the trial court to enforce the agreement. However, the trial court found the agreement unenforceable due to a lack of full disclosure to Korkut regarding its nature. The Court of Appeals affirmed the trial court's decision, declining to address additional issues regarding which Indiana statute governs the agreement and whether it was supported by consideration.
