Haftung und Gewährleistung von PlanerInnen in der höchstgerichtlichen Rechtsprechung: Der Oberste Gerichtshof (OGH) hat sich mit Haftungsfragen rund um PlanerInnen befasst und wichtige Rechtssätze formuliert. Ein Planervertrag kann als Werkvertrag oder Bevollmächtigungsvertrag qualifiziert werden, je nach Inhalt. Die Rechtsnatur des Vertrages ist relevant für die Rechte und Pflichten des Architekten/Planers und die Beurteilung der geschuldeten Leistung. Der OGH hat entschieden, dass der Architektenvertrag als Werkvertrag zu beurteilen ist, wenn vom Architekten nur Pläne herzustellen sind, und als Bevollmächtigungsvertrag, wenn er auch mit der Oberleitung des Baues und der Örtlichen Bauaufsicht betraut ist. Wenn die Baugenehmigung nicht erteilt wird, liegt dies grundsätzlich in der Risikosphäre des Bauherrn, es sei denn, der Planer hat eine Garantie für die Erteilung der Baugenehmigung übernommen. Der Planer schuldet nur ein sorgfältiges Bemühen zur Erlangung der Baugenehmigung, nicht jedoch einen Erfolg.
