Summary

Das Bundesverfassungsgericht hat den Antrag auf Erlass einer einstweiligen Anordnung zur Aussetzung der Vollziehung der nachträglichen Sicherungsverwahrung abgelehnt. Der Beschwerdeführer, der wegen schwerer Sexualstraftaten vorbestraft ist, hatte sich auf das Urteil des Europäischen Gerichtshofs für Menschenrechte vom 17. Dezember 2009 berufen, das die deutsche Regelung zur nachträglichen Sicherungsverwahrung als verfassungswidrig angesehen hatte. Das Bundesverfassungsgericht führte jedoch eine Folgenabwägung durch und kam zu dem Ergebnis, dass die Nachteile, die entstehen würden, wenn der Beschwerdeführer freigelassen würde und dann weitere Straftaten verüben würde, schwerwiegender sind als die Nachteile, die dem Beschwerdeführer durch den Vollzug der Sicherungsverwahrung entstehen. Das Gericht befand, dass das Sicherheitsinteresse der Allgemeinheit das Interesse des Beschwerdeführers an der Wiedererlangung seiner persönlichen Freiheit überwiegt.
