Summary

Der BGH hat das Urteil des Landgerichts Mannheim vom 17. Januar 2002 aufgehoben, da die Verurteilung des Angeklagten wegen unerlaubten Handeltreibens mit Betäubungsmitteln in nicht geringer Menge auf einer unzureichenden Beweisgrundlage beruht. Das Landgericht hatte angenommen, dass der Angeklagte in den Kalenderwochen 13 bis 20 des Jahres 2001 acht Taten des unerlaubten Handeltreibens mit Betäubungsmitteln in nicht geringer Menge in Tateinheit mit unerlaubtem Erwerb begangen hatte, jedoch beruhte diese Annahme lediglich auf Vermutungen. Der BGH hat festgestellt, dass die Feststellungen des Landgerichts nicht ausreichten, um den Schuldspruch zu begründen, und dass die Sache daher neu verhandelt werden muss. Zudem hat der BGH angeregt, dass die Unterbringung des Angeklagten in einer Entziehungsanstalt in Betracht gezogen werden sollte, da der Angeklagte seit vielen Jahren Heroinkonsument ist und den Betäubungsmittelhandel betrieben hat, um seinen Eigenkonsum zu finanzieren.
