Summary

the rules regarding responsibility, infractions, and sanctions in the public employment sector, as per the Testo Unico sul Pubblico Impiego (Decreto Legislativo 30 marzo 2001, n. 165), specifically from Title IV of the updated text (DLgs 75/2017). Key points include:

1. Responsibility and Infractions:
- The rules apply imperatively to public administration employees.
- Dolosa or colposa violation of these rules by employees constitutes disciplinary misconduct.
- The type of infraction and related sanctions are defined by collective labor agreements and must be published on the administration's website.
- The publication on the website is equivalent to affixing the code of conduct at the workplace entrance.

2. Procedural Rules:
- Collective bargaining cannot establish procedures for appealing disciplinary measures.
- It can, however, establish non-obligatory conciliation procedures for cases not involving dismissal, to be completed within 30 days of the infraction and before the sanction is imposed.
- The conciliation procedure's start and end are defined by the collective agreement.
- For serious infractions by directors, the final decision is made by the director general or the head of the organization.

3. Disciplinary Procedure:
- For minor infractions, the disciplinary procedure is handled by the head of the department where the employee works.
- Each administration defines the office competent for disciplinary procedures for more serious infractions.
- Administrations can agree to unify the management of these functions without additional financial burden.
- The responsible department must immediately signal any relevant disciplinary facts to the competent office, which must contest the infraction within 30 days and summon the employee for a hearing within 20 days.
- The employee has the right to be assisted by a representative and to access the case's files.
- The disciplinary procedure must be concluded within 120 days of the infraction's contestation.
- The employee's name is replaced by an identification code in communications to the Public Function Inspectorate to protect their privacy.

4. Communication of the Disciplinary Procedure:
- The contestation of the infraction to the employee is made via certified email, if the employee has an appropriate email address, or by hand delivery. If not, it is sent via registered mail.
- The communication of the contestation must be made within 5 days of the infraction's discovery.
