Our Terms and Conditions of Purchasing apply to all contracts and orders for the supply of goods and/or services, and also apply to all future business relationships. Deviant or supplementary terms and conditions set by the Supplier are not binding unless expressly agreed. The contract is concluded under the condition that the Supplier fills in and returns our questionnaire-forms. The Supplier's offers are free of charge, and we reserve our rights of title and intellectual property rights in all documents handed over to the Supplier. The Supplier has a duty of confidentiality concerning our documents. Unless otherwise agreed, the price stipulated in the purchase order is binding, and payments are made subject to any legal pleas and objections. The delivery period or date given in our order is binding, and we are entitled to statutory rights and remedies in case of delayed delivery. A contractual penalty of 1% of the order value per week or part thereof will be invoiced in case of delay. We are entitled to claim statutory claims for defects without limitation, and the Supplier is liable for consequent damages.
