Summary

The New Jersey Law Against Discrimination (LAD) is expanding to include novel theories of liability, making it a challenge for employers to defend against claims. Two recent cases, Meade v. Township of Livingston and Morris v. Rutgers-Newark University, have further broadened the scope of the LAD. In Meade, the court held that discriminatory conduct by a subordinate towards their supervisor can result in liability for the employer. In Morris, the court found that a hostile environment can be formed in the mind of one member of a protected class, even if the event was directly experienced by another. These decisions require employers to be more vigilant and implement additional processes and procedures to mitigate risks, potentially increasing compliance costs.
