The protection of traditional knowledge and regulation of biopiracy are crucial to promote technological innovation, ensure the transfer and dissemination of technology, and balance rights and obligations. International treaties and conventions, such as TRIPS and CBD, play a significant role in facilitating the advancement of technology and regulating the misuse of knowledge. However, the existing global and domestic regimes to protect traditional rights are inadequate, and biopiracy remains a significant concern. Traditional knowledge refers to the knowledge, innovations, and practices developed and sustained by indigenous communities, while biopiracy is the act of financially appropriating biochemical or hereditary processes occurring naturally without equitable compensation to the communities from whom it originates. The paper explores the international landscape on protection of traditional knowledge, analyzes the existing international legal framework, and discusses possible solutions to fill the existing gap in terms of protection of traditional rights through IPR as a tool.
