This two-day seminar delves into advanced topics in patent law, focusing on recent Supreme Court and Federal Circuit decisions, inter partes review (IPR), and obviousness analysis.

Day 1 (Morning Session):

Recent Blockbuster Supreme Court & Federal Circuit Cases:
Halo Electronics (enhanced damages, willful infringement)
Carnegie Mellon (willful infringement, enhanced damages)
Lexmark (exhaustion)
The Medicines Co. v. Hospira (on-sale bar)
Cuozzo Speed Technologies (inter partes review, appeals, broadest reasonable construction)

Day 1 (Afternoon Session):

Inter Partes Review I: Appellate Review & Broadest Reasonable Construction
Discussion of key cases including SightSound Technologies, Versatam, MCM, Ethicon, GTNX, Achates, Synopsys, Shaw, Harmonic, and HP.
Inter Partes Review II: Claim Amendments & Procedural Fairness
Analysis of Proxyconn, Prolitec, Synopsys, Nike, and Aqua Products cases regarding claim amendments during IPR.
Examination of Belden, Ariosa Diagnostics, Straight Path, SightSound Technologies, Redline Detection, Nike, Dell, Intelligent Bio-Systems, SAS Institute, and Genzyme Therapeutic cases on procedural fairness and due process in IPR and post-grant review.

Day 2 (Morning Session):

Inter Partes Review III: Obviousness - Comparing IPR & District Court Litigation
In-depth look at cases like Circuit Check, Allergan, Belden, MCM Portfolio, SightSound Technologies, Merck & Cie v. Gnosis, Redline Detection, Ethicon Endo-Surgery, TriVascular, Shaw Industries, Pride Mobility, and Intelligent Bio-Systems to understand the nuances of obviousness analysis in different forums.
