Summary

La sentencia del Tribunal Supremo de 23 de mayo de 2019, dictada en el recurso de casación 4126/2016, resuelve sobre la nulidad de un contrato de swap ligado a la inflación suscrito en 2008 entre un particular y el Banco Santander, declarando la nulidad del contrato por vicio en el consentimiento y condenando al banco a restituir las liquidaciones percibidas y los intereses legales. La sentencia de la Audiencia Provincial de Santa Cruz de Tenerife había estimado el recurso de apelación del banco y desestimado la demanda por caducidad de la acción, pero el Tribunal Supremo revoca esta sentencia y estima el recurso de casación del demandante.
