Summary

La empresa Locrifer S.L. concertó un contrato marco de operaciones financieras y un contrato de opciones de tipo de interés collar con barrera knock-out con Banco Santander S.A. en 2008, pero posteriormente demandó al banco solicitando la nulidad de los contratos y la restitución de las cantidades percibidas. El Juzgado de Primera Instancia de Almería estimó la demanda, pero la Audiencia Provincial de Almería revocó la sentencia y desestimó la demanda. Locrifer S.L. interpuso un recurso extraordinario por infracción procesal y un recurso de casación, que fueron admitidos por el Tribunal Supremo.
