Summary

La Cour Commune de Justice et d’Arbitrage (CCJA) de l’Organisation pour l’Harmonisation en Afrique du Droit des Affaires (OHADA) a rendu un arrêt le 09 mars 2023, dans l’affaire opposant la Société Internationale de Contrôle Aéroportuaire et Services de Sûreté Cameroun (SICASS Cameroun) à Monsieur KOUOMO Célestin. La SICASS Cameroun a formé un pourvoi contre l’arrêt de la Cour d’appel du Littoral à Douala, qui avait confirmé l’ordonnance du premier juge liquidant une astreinte à la somme de 2.475.000 francs. La CCJA a cassé l’arrêt attaqué, considérant que le juge du contentieux de l’exécution n’est pas compétent pour liquider les astreintes, et a décidé d’évoquer l’affaire.
