Texas law requires real estate licensees to disclose information about brokerage services to prospective buyers, tenants, sellers, and landlords. There are two types of license holders: brokers and sales agents. A broker is responsible for all brokerage activities, while a sales agent must be sponsored by a broker. Brokers have minimum duties, including putting the client's interests above all others, informing the client of material information, answering questions, and treating all parties honestly and fairly. A license holder can represent a party in a real estate transaction as an agent for the owner, buyer/tenant, or both as an intermediary. Intermediaries must treat all parties impartially and fairly, and may not disclose confidential information unless authorized in writing. All agreements between the client and broker should be in writing, clearly establishing the broker's duties, responsibilities, and payment terms.
