Summary

The Coronavirus Act 2020 modifies existing legislation in response to the pandemic, affecting commercial landlords and tenants. Prior to the Act, a landlord could forfeit a lease if a tenant breached a condition or covenant, with exceptions for non-payment of rent. The Act prohibits landlords from enforcing a right of re-entry or forfeiture for non-payment of rent from March 26, 2020, to June 30, 2020, or a later specified date. However, it does not prevent landlords from enforcing a right of re-entry or forfeiture for other breaches of covenant. Landlords can still try to recover rent arrears through proceedings, statutory demands, or winding-up petitions. Tenants may apply for relief from forfeiture to regain their position. The Act's provisions aim to provide temporary protection for tenants while allowing landlords to pursue other remedies.
