Summary

De wetgever heeft artikel 7:306 BW ingevoerd om de onderhuurder van een bedrijfsruimte te beschermen. Dit artikel bepaalt dat de onderhuurovereenkomst eindigt op het moment dat de hoofdhuurder het gehuurde moet ontruimen op grond van een vonnis. De wetgever wilde voorkomen dat de onderhuurder gedwongen wordt om het gehuurde te verlaten terwijl de onderhuurovereenkomst nog voortduurt. Artikel 7:306 BW is semidwingend, wat betekent dat het niet ten nadele van de huurder kan worden afgeweken zonder goedkeuring van de rechter. De onderverhuurder is verplicht om de schade te vergoeden die de onderhuurder lijdt als hij niet of niet juist heeft voorgelicht over de termijn van de hoofdhuur of als hij onvoldoende heeft gewaakt voor de belangen van de onderhuurder bij de beëindiging van de hoofdhuur.
