Regarding the obligation to record discussions - a legal opinion in the courts! For the family and the courts, the writer of this opinion states: It is the duty of every father to record the discussion in family courts and rabbinical courts.
As is known, Section 70 of the Courts Law states: "No person shall publish any matter regarding a discussion that took place in a closed court, except with the permission of the court." It also states: "A person shall not photograph in a courtroom and shall not publish such a photograph, except with the permission of the court."
However, this section only prohibits publication and photography, not recording.
Additionally, the Basic Law: The Judiciary states that "a court shall sit in public, unless otherwise determined by law or unless the court orders otherwise." This law takes precedence over the Courts Law.
In family courts and rabbinical courts, judges themselves publish verdicts while omitting names, effectively determining the meaning of publication.
The problem is exacerbated by the fact that judges in these courts systematically practice gender discrimination, causing human harm to our children.
The "Fathers for Justice" association states that fathers have the right and duty to represent their children, as stated in the Legal Capacity and Guardianship Law.
The association also notes that the discrimination practiced in these courts is corrupt and that the protocols often conceal the judges' role in this discrimination.
In Israel, there is no "fruit of the poisonous tree" doctrine, meaning that evidence obtained illegally is still admissible in court.
Therefore, it is the duty of those who want to protect themselves and their children to record discussions in court, without publishing them before consulting with a lawyer.
Recording has historical significance in the struggle for equality and can serve as evidence of corruption, such as the admission by Judge Bar-Yosef that was recorded.
