Tennessee Supreme Court Rule 9, section 33 permits direct appeal to the Supreme Court from circuit or chancery court decrees when either party is dissatisfied. The appeal is determined solely on the transcript of the record from the circuit or chancery court, including the hearing panel's evidence transcript, and the parties' briefs without oral argument unless ordered otherwise. This rule overrides prior interpretations requiring appeals to the Court of Appeals under Tenn. Code Ann. § 16-4-108. Appeals must be filed within sixty days of the hearing panel's judgment entry, with timing adjusted if a costs assessment application is timely filed. The trial court may stay the hearing panel's judgment pending appeal upon motion. The Supreme Court designates a special judge (not geographically tied to the case location) to review the appeal. Except as otherwise provided in Tennessee Rules of Appellate Procedure 24-30, these procedures apply.
