CASE AND TRIAL MANAGEMENT GUIDELINES FOR COMPLEX PROCEEDINGS:
1. Applicable to complex proceedings requiring at least 5 trial days.
2. Parties can request to be added to a short-notice-trial waiting list.
3. Electronic documents: Court encourages electronic production, specifics to be set out.
4. Discovery planning: scope, exchange, and content to be discussed with case management judge.
5. Limits on oral discovery:
- 1 day for trials scheduled for 5 days or less,
- 2 days for 6-10 days,
- 3 days for 11-20 days,
- 4 days for 21 days or more.
6. Examination for discovery: no questions under advisement, answers unless clearly improper.
7. Limits on refusal motions: no motions until discoveries complete, limited to 1 hour per day.
8. No motions within 60 days of trial without leave.
9. Motion for commission evidence to be brought as soon as necessary, no later than 2 months before trial.
10. Strict enforcement of limit on expert witnesses: 5 per party.
11. Experts to outline areas of agreement, state where they agree and disagree.
12. Experimental testing: notice to be provided 2 months before scheduled service of expert report.
13. Expert reports to be submitted 2 weeks before trial, undertaking to call expert as witness.
14. Trial management conference to be requisitioned 2 months prior to trial, agenda to be proposed.
