Summary

The Family and Medical Leave Act of 1993 provides eligible employees with job-protected, unpaid leave for up to 12 workweeks in a 12-month period for certain family and medical reasons, including the birth of a child, adoption, foster care, serious health conditions, and military family leave. The Act was amended in 2008 to include new military family leave entitlements, allowing eligible employees to take leave to care for covered servicemembers with a serious injury or illness and for qualifying exigencies arising out of a covered military member's active duty. The Department of Labor has issued final regulations implementing the FMLA, which are effective January 16, 2009. To be eligible for FMLA leave, an employee must have been employed for at least 12 months and have worked at least 1,250 hours in the 12 months preceding the leave. Employers covered by the FMLA must maintain group health coverage for eligible employees during the leave period and reinstate them to the same or an equivalent job upon return.
