Summary

The federal Family & Medical Leave Act (FMLA) and Wisconsin Family & Medical Leave Act (WFMLA) provide eligible employees with job-protected unpaid leave for family and medical reasons. FMLA allows 12 workweeks of leave and 26 workweeks to care for a covered service member, while WFMLA allows 2 workweeks for serious health conditions, 2 workweeks to provide care, and 6 workweeks for childbirth or adoption. Eligible employees must have worked for the State of Wisconsin for at least 12 months and 1250 hours for FMLA, or more than 52 consecutive weeks and 1000 hours for WFMLA. Covered reasons for leave include serious health conditions, caring for family members, birth or adoption of a child, and qualifying exigencies related to military service. Employees must provide medical certification, and employers must respond to leave requests within 5 business days and designate leave within 5 business days of receiving completed certification.
