Summary

The Home Office uses detention as a means of ensuring those who seek to enter or stay in the UK illegally are prevented and deterred, but has a legal duty to deal humanely with detained individuals, particularly those with mental health conditions. Home Office policy states that certain categories, including those with serious mental illnesses, are normally considered suitable for detention only in exceptional circumstances. However, the presence of mental health issues does not automatically preclude detention, and the policy provides for exceptional circumstances where detention may be necessary despite mental health concerns. The Home Office accepts that detention can be stressful and exacerbate existing mental health conditions, and that it has not always made the right decisions regarding detention of those with mental health conditions. A review by the Tavistock Institute aims to improve the treatment of those with mental health issues in immigration detention while maintaining a robust system of immigration enforcement. The review considers issues such as identifying mental health issues, seeking timely specialist help, improving communication between staff and caseworkers, and improving caseworkers' understanding of mental health implications. The objectives of the review include improving identification and treatment of mental health issues, taking mental health into account in decision-making, and improving communication between removal centers, caseworkers, and NHS trusts.
