Summary

The PUMP for Nursing Mothers Act amends the Fair Labor Standards Act to require employers to provide reasonable break time and a private space for employees to express breast milk for one year after a child's birth. Employers with less than 50 employees are exempt if compliance would cause significant difficulty or expense. Air carriers are exempt with respect to crewmembers, and rail and motorcoach carriers have specific exemptions and requirements. Employees must notify employers before commencing an action for non-compliance, unless the employee has been discharged or the employer has indicated no intention of complying. The Act does not preempt state laws providing greater protections and has no effect on title 49 preemption. Remedies for non-compliance are clarified, and employees are authorized to temporarily obscure the field of view of an image recording device on a locomotive or rolling stock while expressing breast milk.
