Summary

Commercial purchasers of imported merchandise who choose not to be importers of record for US Customs purposes may still be subject to recordkeeping requirements and liable for penalties for failure to maintain required records. The Customs Modernization Act and implementing regulations establish specific responsibilities for recordkeeping, including maintaining documents such as purchase orders, invoices, and packing lists. Non-importers of record who "knowingly cause" importation, such as those who arrange for importation and delivery on a "landed cost" or "delivered duty paid" basis, are considered "covered persons" under the recordkeeping requirements. They must maintain records normally kept in the ordinary course of business and may be required to provide information based on identification such as seller identity, purchase order or invoice numbers, and delivery dates.
