La Disposición CoEIS N° 40 establece el ámbito de aplicación y el registro de investigaciones en seres humanos, considerando la Ley 9694/09 y su Reglamentación, así como el Código Civil y Comercial de la Nación. Define los conceptos de "investigación médica en seres humanos", "acto médico", "intervención en investigación", "variable de estudio", "investigación observacional" y "investigación experimental o ensayo". También establece que las investigaciones no reguladas deben ser evaluadas por un Comité Institucional de Ética en Investigación en Salud (CIEIS) acreditado y registradas en el Registro de Investigaciones en Salud (RepIS) o en un registro local. El objetivo es supervisar y regular las investigaciones que conllevan un mayor riesgo para los seres humanos que participan en ellas.
