Summary

The European Union Act 2011 is a failed statute due to its flaws, including not truly empowering the people and being legally inconsistent. The Act was a compromise between the coalition parties, aiming to pacify the Europhobic wing of the Conservative party. It affirms the validity of EU law in the UK through the European Communities Act 1972 but neglects to address the supremacy of EU law. The Act introduces a referendum requirement for certain Treaty changes, but this is undermined by exclusions, such as EU enlargement, and does not diminish the government's powers. The Act enhances Parliamentary control over EU decision-making but fails to create fundamental constitutional protection, instead offering shallow political protectionism. It is legally inconsistent, constitutionally pointless, institutionally botched, and politically regressive, making it a bad law that will likely be damaging in the long run.
