Summary

Aviation is a major source of emissions in Europe, increasing 21% in the last three years, and is projected to continue growing. To meet climate targets, fiscal policy can play a key role, and taxing aviation fuel is an option. Despite misconceptions, the Chicago Convention does not prohibit taxing aviation fuel, and the Energy Tax Directive allows member states to tax aviation fuel for domestic and intra-EU flights. A recent study suggests that regulatory hurdles can be overcome by including a de minimis exemption, and that taxing aviation fuel on flights between member states is feasible without contravening existing air services agreements. The study recommends speeding up the renegotiation of agreements to abolish fuel tax exemptions for foreign carriers and considering the option to abrogate mutual fuel tax exemption clauses. Implementing a fuel tax could help reduce emissions and spur moves to resolve legal obstacles to its wider application.
