Summary

HIV criminalisation is a global issue, with laws often accompanied by punitive measures against people based on their HIV status, undermining public health goals and human rights. The N'Djamena Model Law and SADC Model Law were introduced to address this, with the latter aiming to be more inclusive and protective of human rights. Despite some successes in decriminalising HIV, gains have been made over the past decade, with global, regional, and national campaigns contributing to these successes. The AIDS and Rights Alliance for Southern Africa (ARASA) has played a pivotal role in the fight to end HIV criminalisation, partnering with parliamentarians, judiciary, and advocates to promote a human rights-based response to HIV.
