Summary

Civic space matters during a pandemic as it allows people's voices to be heard, builds trust in the health system, and helps identify flexible solutions to urgent needs. However, there are concerns that measures to protect public health may be overbroad or discriminatory, and that exceptional measures may infringe on certain rights. To address this, states should ensure that measures are necessary, proportionate, non-discriminatory, and limited in duration.

States should encourage participation in COVID-19 response by creating avenues for feedback, reaching out to those most at risk, and maintaining existing channels of civil society participation. They should also maximize access to information by sharing relevant and reliable information, facilitating access to the internet, and countering disinformation with credible information.

Respecting freedom of expression is crucial, and limitations on access to relevant data, censorship, and restrictions on journalistic activity can undermine an effective response to COVID-19. States should provide a space for medical professionals and experts to speak freely, and protect civil society by recognizing their contributions, ensuring continued funding, and releasing defenders detained in connection with their human rights work.

Finally, states should uphold freedom of assembly by ensuring that restrictions on physical gatherings are based on law, necessary, and proportionate to the aim, and consider how protests may be held consistent with public health needs.
