Summary

The need for international criminalization of biological and chemical weapons (BCW) is motivated by concerns over their potential use as instruments of terror, coercion, and mass killing. The Draft Convention aims to establish individual criminal liability for BCW-related offenses, differing from current international legal obligations that focus on state activities. Adoption of the Draft Convention would create a new dimension of constraint against BCW, employing international criminal law to provide jurisdiction to national courts against individual offenders. It would build upon existing conventions, such as the Geneva Protocol, Biological Weapons Convention, and Chemical Weapons Convention, by providing a comprehensive framework for criminalizing individual misuse of BCW. The Draft Convention would make it a crime under international law to develop, produce, acquire, stockpile, retain, transfer, or use BCW, and would help remove jurisdictional inconsistencies between states. Its implementation would strengthen the norm against BCW, enhance deterrence, and facilitate international cooperation in suppressing prohibited activities.
