Summary

New York State legalized adult-use cannabis on March 31, 2021, through the Marijuana Regulation & Taxation Act (MRTA), which creates the Office of Cannabis Management to oversee the law. Employers must adhere to MRTA standards, but can establish policies prohibiting employee impairment by cannabis in the workplace. The law protects medical cannabis patients from discrimination and prohibits employers from taking action against employees for using cannabis outside of work hours, except in certain circumstances, such as impairment on the job or federal law requirements.
