Summary

The Family Medical Leave Act (FMLA) requires employers to provide eligible employees with specific notices of their FMLA rights and responsibilities and designate the leave as FMLA when appropriate. Employers must post a general notice of the FMLA provisions and distribute it to employees. When an employee requests FMLA leave, the employer must respond within five business days using the FMLA DOL Form "Notice of Eligibility and Rights & Responsibilities (WH-381)". To be eligible for FMLA, an employee must have been employed for at least 12 months and 1,250 hours of service in the 12-month period preceding the leave. Employers may request medical certification, but not for leave to bond with a healthy newborn or adopted child. Employees may take FMLA leave intermittently or on a reduced schedule, and employers must allow up to 15 calendar days for completion and return of certification forms. If a certification is incomplete or insufficient, the employer must provide the employee seven calendar days to correct the deficiency. The employer may contact the employee's healthcare provider for clarification and authentication. The DOL provides a model Designation Notice (Form WH-382) to notify the employee whether their FMLA request has been approved or denied.
