Summary

The Centers for Medicare & Medicaid Services (CMS) published a final rule revising the Conditions of Participation (CoPs) for Home Health Agencies (HHAs), effective January 13, 2018, which eliminated the definition of "subunit." Existing subunits must either become distinct HHAs, meeting all CoPs independently, or become a branch of their parent HHA, with the parent providing direct support and administrative control. Subunits that become distinct HHAs must submit a revised CMS-855A and Form CMS-1572a, while those that become branches must have their parent submit a revised Form CMS-1572a and evidence of supervision. The State Survey Agency (SA) will review and verify compliance with CoPs, and the CMS Regional Office will approve the transition of subunits to branches.
