Summary

The Opposition Division had found that the patent's claims lacked novelty and inventive step, and the Board of Appeal agreed, citing prior art documents D1 and D2. The Board also found that the patent's claims contravened Article 123(2) EPC due to inconsistencies between the description and the claims. The patent proprietor's auxiliary requests I and II were also rejected for lack of inventive step.
