Summary

The Virginia Supreme Court ruled that legislative privilege, as set forth in the Speech or Debate Clause of Article IV, Section 9 of the Constitution of Virginia, extends to Members of the General Assembly, but not to the Division of Legislative Services (DLS) or documents and communications between Members and consultants, DLS, or other third parties. The court held that the circuit court abused its discretion by holding the appellants in contempt for refusing to comply with a production order, and vacated the production order and contempt ruling in part. The case involved a challenge to the constitutionality of certain legislative districts, and the appellants had claimed legislative privilege to avoid producing documents and communications related to the redistricting process.
