Summary

The transport contract is governed by the CMR convention and the present terms and conditions, which take precedence over any other terms and conditions. The consignor guarantees that the consignee is aware of and agrees to these terms and conditions. The carrier is not liable for damage caused during loading and unloading operations, unless explicitly agreed otherwise. Deliveries are made at the threshold or quay of the premises, and the carrier can object to instructions that jeopardize the vehicle or cargo. The consignor is responsible for excess weight during transport and must pay resulting costs. The carrier's liability is limited to 8.33 SDRs per kilogram of lost or damaged goods, with a maximum of 25,000 euros per event. The carrier is entitled to compensation for standstill times and has a lien on equipment and goods for payment of amounts due. Invoices are payable without discount, and late payment yields interests and a fixed compensation of 10%.
