Summary

The Dutch Copyright Act (DCA) of 1912 does not provide justifications for copyright protection in its preamble or explanatory remarks. However, the parliamentary documents of the 1881 Copyright Act mention that the state is bound to create a temporary and exclusive author's right on utilitarian grounds, as well as for reasons of fairness and justice. The Dutch Neighbouring Rights Act (DNRA) of 1993 also lacks justifications in its preamble, but the parliamentary documents mention economic objectives and social objectives, such as safeguarding investments and employment. The influence of these justifications on the provisions of the law is not clear, but they are reflected in the recognition of moral rights and specific provisions of contract law. Legal literature in the Netherlands is scarce on the topic, but some scholars have proposed alternative justifications, such as fairness, labour, and unjust enrichment.
