Summary

قانون مجموعه قواعد حقوقی الزام‌آوری است که از طرف هیئت حاکمه به منظور حفظ جامعه و تامین حقوق اشخاص وضع گردیده و تطبیق آن توام با اجبار است. قانون اساسی افغانستان مصوبه هر دو مجلس شورای ملی بعد از توشیح رئیس جمهور عبارت از قانون است. در کل از دو نوع قانون، قانون اساسی و عادی می‌توان نام برد. قانون اساسی مجموعه دستوراتی است که تشکیلات دولت را به معنای وسیع تنظیم نموده رابطه بین اتباع و دولت را تضمین می‌نماید و دارای خواص ذیل است: حدود حقوق افراد را تثبیت و حدود استعمال سلطه دولت را معین می‌سازد، ارگان‌های دولتی را معین نموده و صلاحیت‌های این ارگان‌ها را مشخص می‌سازد، رابطه بین اعضای جامعه (دولت و افراد) را تعیین نموده و تضمیناتی را که به افراد داده شده ثبت می‌نماید.
