However, the court reversed the Court of Appeals' judgment regarding the defendant's ability to assert an affirmative defense under § 8, holding that a defendant need not establish the elements of § 4 immunity to establish the elements of the § 8 defense. The case was remanded to the Kent Circuit Court for further proceedings.
