Summary

La Sala de lo Constitucional declaró inconstitucional la Ley de Amnistía General para la Consolidación de la Paz de 1993, por violar artículos de la Constitución y tratados internacionales de derechos humanos. La amnistía es contraria al derecho de acceso a la justicia y a la reparación integral de las víctimas de crímenes de lesa humanidad y crímenes de guerra. La Sala estableció que los artículos 1 y 4 de la ley son inconstitucionales y que los crímenes de lesa humanidad son imprescriptibles y no pueden ser objeto de amnistía. La sentencia declara inconstitucionales los artículos 2, 3, 4, 5 y 7 de la ley y establece que la amnistía sigue siendo aplicable a quienes no hayan participado en crímenes de lesa humanidad y crímenes de guerra.
