Summary

The European Court of Justice (ECJ) declared the Data Retention Directive (DRD) invalid in 2014 due to its interference with fundamental rights to private life and personal data. The DRD, adopted in 2006, required electronic communication providers to retain certain data for 6 months to 2 years to help fight crime and terrorism. The ECJ ruled that the directive exceeded the limits of proportionality, and its retention of data without informing subscribers or users generated a feeling of constant surveillance. Following the ruling, national courts cannot apply the directive, and national acts transposing it are not automatically annulled. A survey by Europol found that at least 7 EU Member States no longer have valid legislation on data retention, while others are reviewing their laws. Despite this, Member States confirm that data retention has a positive impact on preventing and investigating serious crimes and terrorism.
