The Court of Appeal considered the overlap between adjudication decisions in Sudlows Ltd v Global Switch Estates 1 Ltd, allowing an appeal against a TCC decision. The case involved two adjudications, Adjudication 5 and Adjudication 6, concerning delays and extension of time claims under a JCT Design and Build Contract. The Court of Appeal applied three key principles: the "pay now, argue later" purpose of adjudication, the need to consider the first adjudicator's decision, and the need for flexibility in preventing re-adjudication of issues. The court held that the second adjudicator, Mr Molloy, was right to conclude he was bound by the first adjudicator's decision, Mr Curtis', as Mr Molloy properly explained how and why he considered himself bound, looking at what Mr Curtis had actually decided. The Court of Appeal overturned the TCC's decision, finding that Mr Molloy's primary decision was enforceable, and that Sudlows was entitled to an extension of time and payment.
